A MAN’s conviction and sentence for sexual assault of an underage girl was upheld in the Court of Appeal yesterday.
Modesta Colebrooke, 44, appeared before Justices Anita Allen, Jon Isaacs, and Stella Crane-Scott for his expected hearing contesting his conviction in Magistrate’s Court for unlawful sexual intercourse of a minor back in 2010.
He was sentenced to two years’ imprisonment when convicted in 2014.
Colebrooke told the appellate judges yesterday: “I’ve since put this matter behind me and I don’t wish to burden the court with this.”
Colebrooke said his punishment has already been completed as he had been in custody for nine months prior to trial and 14 months since being convicted.
“What is your most recent conviction?” Justice Isaacs asked.
Colebrooke said he was convicted in June for assault and causing harm charges dating back to 2008 and was sentenced to eight months in prison.
He said he was contesting the conviction “because of the fact that the investigating officer never gave evidence and (the) magistrate closed the matter”.
“I thought it was not fair,” he added.
The appellate court affirmed the conviction and sentence for the unlawful sexual intercourse charge.
A date has not been set for his appeal against the conviction for assault and causing harm.
