THE murder trial into the shooting death of businessman Kurt McCartney will now be heard in November, after a second consecutive delay.
In what was supposed to be the start of trial yesterday before Acting Chief Justice Stephen Isaacs, it was revealed that lawyers Ian Cargill and Sonia Timothy, who represent two of the accused in the case, are still in a murder trial before another judge. That case is expected to go on for another two weeks.
The Crown also had to submit outstanding documents not disclosed to lawyers for the accused that will be used as evidence in the trial against Lyndera Curry, 21, Sumya Ingraham, 26, Thorne Edwards, 23, and Okell Farrington, 31, for the October 24, 2013 murder. As a result, the case was adjourned to November 23 for trial.
The case was initially to be heard on September 28 but the judge was still presiding over the trial of murder accused Donna Vasyli and the matter was adjourned to yesterday’s date.
Along with murder, the four are also charged with armed robbery. It is claimed that while armed with a handgun, they robbed McCartney of his 2007 Hummer vehicle, valued at $37,000. The victim, the brother of Democratic National Alliance (DNA) Leader Branville McCartney, was shot and killed in Gambier Village two years ago. Police discovered his Hummer a few hours after his death, east of Traveller’s Rest restaurant.
At their arraignment in 2013, the accused were not required to enter a plea to either of the charges. They were remanded in custody. They pleaded not guilty to the charges when they made their first appearance in the Supreme Court in 2014.
A fifth person, 42-year-old Terry Delancy, the owner of Virgo Car Rental, was charged with being an accessory after the fact. He is accused of enabling Curry, Ingraham, Edwards and Farrington to avoid due process of the law. He pleaded not guilty to the charge at his arraignment.
He was granted $15,000 bail with one surety and ordered to wear an electronic ankle bracelet.
Mr Cargill is representing Delancy while Ms Timothy represents Curry.
Ingraham, Edwards and Farrington are respectively represented by Romona Farquharson-Seymour, Terrel Butler and Philip Hilton.
