Supreme Court overturns dredging block

Dredging work in Bimini.

Dredging work in Bimini.

A SUPREME Court judge has set aside an injunction on dredging activities in Bimini, giving Resorts World Bimini (RWB) the freedom to restart its dredging activities.

The ruling, which was delivered this morning, comes a week after the Privy Council granted the Bimini Blue Coalition's (BBC) injunction request that the developer would have to prove to the Supreme Court or Court of Appeal that a permit obtained under the Conservation and Protection of the Physical Landscape of the Bahamas Act was valid.

BBC lawyer Fred Smith will immediately seek to appeal Senior Justice Hartmen Longley's ruling, The Tribune understands.

The Senior Justice also ruled that the BBC must pay all the expenses of the government and developers, both before the Privy Council and the Supreme Court.

Michelle Malcolm, RWB's Public Relations Director, said after the ruling: "We are pleased with the ruling and will resume dredging operation today, resulting in many Biminites immediately getting back to work. The people of Bimini know that Resorts World Bimini is an enourmously positive development for the econony and ethos of the island, and we are hopeful that outside special interests will finally cease their litigious efforts to stand in the way of a project that the local people so clearly want."

May as well just shut down the courts and let the government run the legal system. Those judges are spineless and scared to piss off the government and will bend things to suit those needs.

We could shut down the government. That would be a blessed day.

This country is done. Disgusting! Big money rules the day and the average Bahamian should just go away. As soon as they get their foot in the door of Florida they will abandon The Bahamas and leave us with nothing but a suburb of Miami that nobody will want to visit.

3

killemwitdakno 9 years, 10 months ago

There's plenty culture to be found and upheld, people have to be encouraged to go out and look for it. We have to piece our heritage back together. There's efforts big as billy but loudest mouths like yours won't support them, so why should any further attempts be made.

0

jess242 9 years, 10 months ago

Maybe if you opened your ears and eyes you would see that there is a very limited number of Bahamians who actually want this project to go ahead.... hence why there was so much noise when it began and why there were petitions signed BY BAHAMIANS to get this stopped.

3

GrassRoot 9 years, 10 months ago

GeneralCrazy, I officially present you with the honors of calling yourself Bahamaniac, the First. Upgrade from being a soldier, now you are Royalty, but besides that, it is indeed a big big opportunity for the Biminites or most of them. But that is exactly the game the big companies play. Divide and conquer. The Casino in Bimini will be done the day when Florida is so broke that they have no other choice than to allow Gambling, Genting still owns that big piece of land in downtown Miami. Don't be fooled. That day almost happened 2 years ago.

1

Victimized by foreign sponsored gangsters, they still have families to feed and the government is using shock tactics to control. The whole thing is enabled by allowing anyone to say anything dumb, allowing boorish comments who adore politicians that threaten, not asking when something doesn't seem right, and ignoring the source of the dirty money.

There is no Bahamalander more opposed to dredging than I but to accuse a Judge of being a conspirator to what is going on in Bimini is going too far. Comrades make up your flipp'in mind's. rationally and not before bloggers have even read the reasoning behind the Comrade Supreme Court Judge's ruling and yet you blast his ruling. Aren't you the same bloggers who voice so strongly, how this very same Privy Council has no damn business to be modifying death sentences handed down by the Supreme Court? Ya ain't funny but totally confused where you stand on anything, except you sure as hell don't want Minnis leading the reds party come 2017.

The entire flipping Supreme Court is on the payroll of the developers in the country. We are not so stupid and are not surprised by the ruling. And while we are at it let's allow any developer come to the Bahamas destroy the rest of our precious eco-systems. The Bahamas is ripe for a revolution and I pray we have a BIG ONE soon. Get rid of Yellow and Red and let GREEN have a chance to run this country. We truly have the house niggas (Government/Attorneys/Judges) running the field niggas (dats the rest of us yall) off their land. I am so fricking tired of being hoodwinked, lied to and bamboozled. The Bahamas SUCKS!

'

1

Sickened 9 years, 10 months ago

We are ripe for a revolution and certainly need one. BUT, I am sincerely afraid that the General(ly)Crazy's out there will turn any sort of demonstration into a blood bath. The sensible people are stuck in that any large organized protest against this useless Government (and useless opposition) will most likely turn violet with there being soooo many frustrated unemployed gun-toting youths and middle-aged people out there. The DNA aren't even close to being ready to step in, and we have no army general to run the country until elections are called. I'm open to suggestions on how to move the country forward with Bahamians, who love their country, in charge.

This is dimishing to a personal blow by blow. Whoever GENERALCRAZY is needs to let cool heads prevail and understand that we are living in the 21 century. GENERALCRAZY might as well move to New York where Al Sharpton and his [you made us slaves] mentality actually has an audience among the mindless. This is about destroying the fragile coral reefs that surround Bimini. Corrupt officials may rule the Bahamian Courts, but a 1,000 foot pier that doesn't have a Fast Ferry running to it is useless. It has to depart the US of A. And with 45,000 FB followers, I just don't see that happening. They tried their "Cruses to Nowhere" out of the Port of Miami and we shut them down for violation of Immigration Laws. What makes you think they will find a sympathetic Port in The US to sail from to an Island's whose economy and way of life, they destroyed?

2

if DEA is house nigga, massa is.. let's revisit the western instigating war generals shall we. Who are in fact again instigating in the US house as of last week, in plain english. sure, they'd love reason to step in. now i'm starting to agree with the wild theories of certain annexing leaders. The plp's have slapped out our PM before, a number of slaps have gone around, Bahamians aren't going to need any help with that part.

0

killemwitdakno 9 years, 10 months ago

That's the part I don't understand, it was about gutting a whole doc. I thought I saw the pic somewhere, yet there is already a pier which their workers are using. Now suddenly World Resort has changed their wording and have a picture on their site of a less destructive "pier" when there already is one. So what are they out there dredging so vastly? ( boy, when third world does deals with third world who thinks one is dumb as the other is and that they could feed us shyt, rme). For 2 million lost, they could just get environmentally friendly boats and come up to shore or let off at what the have. simple.

We're giving these turds too much credit by going through Privy and protesting. GeneralCrazy needs to use his militantcy on this boat the way he wants.

Let not the Courts financially silence the voices of the people. Comrades while I have not read the reasoning behind the Senior Justice's decision to overturn the Privy Council's dredging block, I must take issue with the Senior Justice's ruling that the Bimini Blue Coalition's (BBC) must pay all the expenses of the "Government and Developers" both before the Privy Council and the Supreme Court. This sends a message to any organization that it can be costly to challenge what you believe to be a wrong being carried out by your own government or foreigner developer. I call upon both Prime Minister Christie through his Attorney-General and the Bimini Developer to immediately deliver a message to the Supreme Court via the media, that they will not pursue financial damages of any kind resulting from legal challenges made by BB.

I believe that is the real scandal here, that the Soupreme Court does not protect the Bahamian interest by shutting citizen down with imposing unrealistic cost for any party. It would be a drop into the bucket for Genting. How about Genting make putting up a bond for the potential damage plus consequential cost they may do to the environment?

The picture posted is a picture of the bank in Bimini being filled in to accommodate town homes on a "Millionaire Island". This fill is the by product from the dredging going on. Not only is this project destroying our reefs but it is terminating the banks which every Bahamian knows is vital to the existence of the conch. The land that is seen in the back drop is called East Well. That is where all the land crabs in Bimini spawn. Also found there is sea grapes and coco plums; a Bahamian delight that will only be a myth to future Biminites because Resorts World plan and have been granted approval to put a golf course there! Bimini has been sold out and that's the God'd honest truth! Off course Biminites want progress but not at the expense of our beautiful reefs and diverse ecosystem! Something needs to be done! The Government has turned its back on Bimini a long time ago and they only frequent here seeking to retrieve whatever they can get! Michelle Malcom is paid to say that this is what Bimini wants but there is no benefit here! Most employees work for less than minimum wage and on some pay periods not even paid all that is owed to them over the 2 week span! The only ones benefiting is Resorts World NOT Bimini!

Well as Einstein theory goes, "Insanity: doing the same thing over and over again and expecting different results." In our case we keep voting the same two wutless governments in again and again and expect better results. And when both government frig up we bitch and moan among ourselves. But we are never prepared to come together as a unit and put a stop to this madness. This group over there fighting this thing, the next group over there doing another. In the main time those who live in their gate communities could care less as long as all the mess don't spill over in part of the community.

How does anyone know it will kill all the reef. It did not here in Abaco when they did it with a dredge just like this. They said it would but they pumped it into the open bay pumping out conchs as it went and made a island. The place has never had as much conchs, fish and crawfish as it does now so some times people are wrong. Talk to some one from Bimini yester day. They told me this is getting blowed up beyond fact. There is only mud mayb 100 feet on each side the dredge and from what they said and i dont know for a fact but was told by them that most Bimini people are for this and pleased that they have work.

0

The Bahamas reefs and waters are dying by the day. Ask your friend who is a lobster fisherman, ask someone you know who goes out and gathers conch. This type of activity does not help their struggling habitat to reproduce. But if the choice is to ignore the historical ways in which Bahamians have nurtured and bore the fruit of the sea, made good livings, to allowing giant virus plagued, poop dumping ships in the same waters....

Then say goodbye to an invaluable asset. Does this one project put the nail in the coffin? no, but the buy offs and look the other way that the government anemically, and most obviously, adheres to will lead to its ultimate death.

Yes sir. Real Name is Mumper. In 1967 thru 1969, I had the dive shop at Browns Hotel. Worked for free with Frank Brown on repairing and keeping the three electric generators running and providing power to the Islanders. I worked [again for free] on the Bimini Trader bringing in fresh water, fuel and food to the island. Again, I worked for free as the only ferry to Cat Cay for the Customs Officers to be able to permit entries through that Island. Again, I worked for free keeping the three ferries between North and South Bimini running. I watched Neil Armstrong set foot on the moon at Buccaneer Point with Adam Clayton Powell and Huffy AFTER I installed [for free] the three hundred foot antennae so that Biminites could share world news in color. In 1967 I raced in the first Bahamas 500 ocean Race. Raced in three Miami to Nassau Boat Races. I did all this before I reached the age of 21. Give some of your history General Crazy other than lip service.

I am just a retired old man who enjoyed the love and respect that I received from the people on Bimini. Pain any picture you like of me. Bottom line just between you and me as men - I contributed more to the lives of Biminites than you as you sit in Providence? Ever been to Bimini? Doubt it. And I must apologize to you personally, I let this fiasco touch my heart and not my intellect. We shouldn't be throwing stones at each other if we truly love this country and it matters not where we call home General; its what's in our hearts that truly counts. I won't be commenting anymore. Lets say you won my man.

Why are we so negative towards people in this country? Ok, we get that there will be strong views and differing opinions on matters of national importance. But why is the Judge being so heavily ridiculed? We are just too personal in this country. When the case was before the Court of Appeal they ruled in favour of RWB. As we all know the Privy Council subsequently, granted an injunction and now the Supreme Court Judge has reviewed the case and made a ruling. Why attack him and his integrity? What makes the Privy Council that much more credible than him? But the irony of this is that Bahamians love to use the Privy Council when its in their favour. When it comes to passing sentence of death the Privy Council should stay out of Bahamian business and we have this go it alone attitude. Isn't that what we all say?

Please, have your strong views and strong opinions. There is no need to tear down our Judges and legal system because it doesn't suit our immediate need to stop this dredging. I am 100% in favour of the dredging being stopped but, that doesn't give me the right to speak poorly of any Judge or legal counsel who has an opposing view within the confines of the law.

Some Comrades say we and the courts should leave this up to Biminites. The rest of us feel they are much to wililng to distort their judgement as long as some foreigner is handing out paychecks and political favoritism's are being handed out. Of all the islands among our 700 Biminites sold themselves over to drug dealers back in the 70's and 80's. I was there and saw what Bimini had become and it was not only ugly but the policemans were actually walking around with loaded machine guns hanging from their shoulders. And, no it was not wildly known in the rest of Bahamaland, never reported in the media but it was ugly.

You may crow about how you speak on Behalf of the Bahamas, but won't share who you really are or what your agenda is other that to disrupt intellectual discussion of what is happening to Bimini. Bet you got a boyfriend who left you too. HMMMM. Bet I hit a nerve then. You are a selfish, mean, spiteful piece of human crap. Prove me wrong and share with everyone on this blog a little a bit about yourself. [Leave the whips and chains out and how many little boys you abused.] BTW leave your profanity at home along with the boys you got tied up. You sick piece of shit.

Guess we hit a nerve didn't we? Couldn't figure out at first why you were so angry. Had to sit and think about it for a while. And it was like the first dawn of light over South Bimini, it struck me. You are an angry pedophile, aren't you General Crazy? You are mad at the entire world because we damn fools like you who prey on little boys. Yep, got it down pat now. All your fellow Bahamians see you for what you truly are. How you say it in any language? OOOOOOOOPS! Your true colors came out for everyone to see. You don't care one way or the other about what is happening in Bimini ~ you are just pissed because we won't let you diddle little boys. All this crap about slaves and slave masters and picking cotton is subterfuge, to allow you to spit out your vile because what you do with little boys is wrong. Fess up, if I am wrong, put your name and reputation out for all to see instead of hiding behind GeneralCrazy. Not only are you a clown, but a coward too. Chester Molester
