Murderer must wait for appeal

A CONVICTED murderer learned yesterday he must wait three weeks before his appeal can be heard.

Damian Stuart, 28, will return to the Court of Appeal on May 2 to appeal his conviction for the 2005 drug-related murder of Terrance Bowles.

The convict and his court-appointed attorney Roger Gomez II appeared in court for the hearing yesterday morning. However, it did not proceed as scheduled because submissions from the applicants were missing.

Mr Gomez told the judges there had been a mix-up at his office due to a change in staff last month.

He said his office received the letter of appointment in March, but he did not know about it until nearly two weeks ago when he was contacted by court staff.

The new secretary brought it to his attention soon after, Mr Gomez said.

He also said he only received trial transcripts from the Supreme Court registry a week ago.

The attorney apologised and said he would be prepared to proceed on May 2.

The Grenfell Avenue man was convicted of committing the Grand Bahama murder in August 2008.

Bowles, 27, at the time, was shot and killed during an argument at an apartment complex in the Gardens Villa Subdivision.

Stuart was convicted and sentenced to 30 years in prison.

Justices Anita Allen, Christopher Blackman and Stanley John are the presiding judges. Prosecutor Sandradee Gardiner represents the Crown.
