Cargill to take further court action against Moss

COUNSEL for suspended NIB Director Algernon Cargill said he is “taking instructions” as to further possible court action against NIB chairman Gregory Moss in view of a statement he released on Tuesday.

Attorney Alfred Sears said Mr Moss “appears” to have breached a court undertaking not to repeat or make similar allegations against Mr Cargill, but noted the release mainly “seems to be a conflict” between him and Prime Minister Perry Christie.

In his statement, the Marco City MP addressed “the three specific allegations which have been made against (him) concerning (his) chairmanship.”

He named the matter of the use of the NIB corporate card, the matter of the issuance of an NIB letter of guarantee to Doctors Hospital, and allegations that he personally made various internal changes to the governance and functioning of NIB, as those “specific” allegations.

Those allegations were outlined in a lawsuit filed by Mr Cargill.

He also revealed the company-issued credit card was provided to him by Mr Cargill.

Mr Sears said yesterday: “Mr Moss as well as NIB would have given an undertaking to the court – it’s clear that they undertook not to repeat the allegations or make similar allegations.

“I think the release speaks for itself. The main thrust of the release, it seems to be a conflict between the chairman and the prime minister – that seems to be the major thrust. But in the process, it does appear to breach the undertaking, as well.”

When asked if there will be any further court action in light of this, he said: “I’m taking instructions now and we act on instructions.”

In court documents filed on December 3, Mr Moss and NIB agreed not to further “publish” the allegations against Mr Cargill or “any similar allegation.”

Mr Cargill first filed legal action against Mr Moss and NIB back in November alleging defamation.

The action came after a letter written by Mr Moss to National Insurance Minister Shane Gibson, concerning the Board’s vote to terminate Mr Cargill, was leaked.

Mr. Cargill, you will be vindicated and we thank you for your exemplory service to our country. Moss has been exposed as nothing but dirty, his allegations now carry no weight. You are a good man and no one can take that from you sir.

Wow...in light of the very serious allegations made against Mr. Cargill, I am floored that you would suggest that he has in some way been vindicated. While it would provide significant peace of mind to me and the Bahamian people at large if Mr. Cargill is exonerated and the allegations against him are proven untrue, it is unbelievable that in the face of the evidence (and the allegations in general) you would dismiss it as weightless. I hope you are not guided solely by your politics here. It is ok to be proud, loud, and FNM, but at the expense of our social security and all benefactors? I say investigate them all, and throw them all in jail if found guilty. I care not who they voted for!
