Documents do not record possession of gun in murder retrial, court hears

ACCORDING to testimony, one of the men accused of killing police officer Jimmy Ambrose on March 29, 1999 was not noted as having a firearm after his arrest, and was seen being beaten up on the night in question.

Two witnesses were called to the stand yesterday in the murder case against Stephen Stubbs, Andrew Davis and Clinton Evans.

The men are accused of killing Ambrose and attempting to murder officer Marcian Scott outside the now closed Club Rock nightclub.

The first of the witnesses – both called to the stand by Romona Farquharson, the attorney representing Clinton Evans – was Debra McClure, a woman inspector at the South Beach Police Station.

The officer said it was she who drafted the document containing the details of Evans’ arrest when he was brought to the Central Police Station.

She said Constable 2078 Ryan arrested Mr Evans, but Constable 229 Rolle and a retired officer, Constable Dames, brought him into the station.

It was claimed that Mr Evans was arrested in connection with possession of an unlicensed firearm and attempted murder, she said.

Ms McClure was shown a copy of the document she drafted at the time to refresh her memory.

She told the court that the document didn’t have any notations indicating that items were brought into the station with Evans.

If a gun was brought into the station with him, she said, a notation of that would have been made on the document.

The second witness, Shandiola Colebrooke, did not appear when called, but the testimony she gave in 2007 was read out by Laura Farmer, the court reporter who recorded Ms Colebrooke’s statements at the time.

Ms Colebrooke was quoted as saying that on March 29, 1999, she and her friends were at Club Rock when a fight broke out involving a man she identified as Eric, who she claimed lived near her in the Yellow Elder area.

She said the fight prompted her and her friends to leave the club.

Upon doing so, they discovered another fight, this one in the parking lot of Club Rock, the witness said.

She said that for between 10 to 20 minutes, some men “ganged up” on another man, who later staggered away from the fight.

She identified the man being ganged up on as Clinton Evans, one of the men accused of killing Jimmy Ambrose and attempting to murder Marcian Scott.

Ms Colebrooke said she and her friend rushed away from the scene, and saw the Yellow Elder man she identified as Eric come into the parking lot with a gun and fire three or four gunshots.
