Man faces jail and $60,000 fine for smuggling Haitian immigrants

A MAN accused of knowingly aiding in the illegal landing of 12 Haitian immigrants faces up to a $60,000 fine and two years imprisonment if convicted.

Shanado Baker, 36, of Malcolm Road East, appeared before Magistrate Samuel McKinney to be arraigned on the charge of “knowingly assisting illegal landing” in contravention of Section 41 (1)(a) of the Immigration Act.

The law states that anyone who commits an offence under this section “shall be liable, if he is the owner or other person in charge of a ship or aircraft that is used in the commission of an offence, to a fine not exceeding $5,000 for each person with respect to whom the offence was committed.”

The person is also liable “to imprisonment for a period not exceeding two years and any ship or aircraft used in the commission of the offence shall be forfeited and shall be proceeded against and condemned in such manner as is prescribed by the Customs Management Act.”

Baker, who pleaded not guilty to the charge, is alleged to be the captain of a boat named “First Strike”. It is also alleged that he helped the immigrants land on Little Inagua on September 5.

He is scheduled to return to Magistrate’s Court on September 16 for a bail hearing while he is scheduled to stand trial on October 20.

He has retained Terria Miller to defend him.
