Teen accused of murder claims he was beaten in custody

THE lawyer for a teenager who was charged in Magistrate’s Court yesterday with murder alleged his client was beaten while in police custody.

Tyshawn Moxey, 19, appeared before Deputy Chief Magistrate Andrew Forbes charged with the death of Danton Woods on September 13.

According to initial police reports, sometime around 9 o’clock that night, police received reports that a male had been shot on Hawthorn Road. When officers arrived, they discovered a man’s body lying face down with what appeared to be gunshot wounds. He was pronounced dead at the scene.

During the hearing, Moxey, who is represented by attorney Jomo Campbell, was not required to enter a plea. As a result, the matter was adjourned to December 4 for service of a voluntary bill of indictment (VBI).

Yesterday, Mr Campbell told the magistrate his client had no injuries when he “voluntarily” turned himself into the Central Detective Unit. Mr Campbell alleged Moxey was beaten and suffocated with plastic bags while in custody, in an attempt to make him confess. He added his client’s jaw was swollen and said Moxey also believed one of his fingers had been dislocated.

In response, Magistrate Forbes said he would make a note of the allegations. He also said he would make a recommendation for Moxey to receive medical treatment while in custody.

In the meantime, the defendant was denied bail and remanded to the Bahamas Department of Correctional Services.

Yesterday, two other men appeared before Magistrate Forbes after they were charged with similar offences.

Andrew Burrows, 30, was accused of murdering Craig Trevor Smith on January 19, 2018.

During the arraignment, the Abaco native was not required to enter a plea and his case was also adjourned to December 4 for service of a VBI.

Burrows is represented by attorney Roberto Reckley. Yesterday, he asked the magistrate to make a note of the defendant’s scoliosis condition, so that arrangements could be made for him to receive the medical attention he needs while in custody.

After informing Burrows that he would be denied bail due to the nature of the charges, the judge assured his counsel that he would make a note of his request.

As a result, the defendant was remanded to prison until trial.

Finally, in a separate incident, Alexander Williams was charged with the attempted murder of Jordan Rolle on September 15.

The 40-year-old was also charged with having a Maverick 12-gauge shotgun in his possession on September 17.

Yesterday, Magistrate Forbes adjourned his matter to December 3 for service of a voluntary bill of indictment (VBI).

In the interim, Williams was denied bail and remanded to BDCS.

All three men have a right to apply to the Supreme Court for bail.
