Retrial ordered for man accused of sex with child

THE Court of Appeal yesterday ordered a retrial after it set aside a judge’s ruling regarding a man who was accused of having unlawful sexual intercourse with a minor.

The Crown recently appealed the trial judge’s order in the case of Joseph Foulkes and yesterday, Justices Sir Michael Barnett, Maureen Crane-Scott and Roy Jones granted the request.

In their judgement they stated: “The learned judge’s ruling is set aside in its entireity... The matter is remitted to the Supreme Court for retrial.”

The panel said that as the matter would be retried, no other details should be published until the case has been completed.

“In the interests of justice and until the conclusion of the criminal proceedings or further order of this court or of the Supreme Court, nothing shall be reported concerning the case except for the limited information specified in the judgment,” the appeal panel stated.
