Man fined for cocaine

A 32-year-old man who claimed he used cocaine as an antibiotic to help alleviate his immune deficiency disorder has to pay $100 to avoid spending a month behind bars.

Police arrested Naylando Moxey, also known as “Sticky Weed”, after they found three grams of cocaine in his trouser pocket on March 20.

He pleaded guilty to possession of dangerous drugs with the intent to supply during his hearing before Deputy Chief Magistrate Andrew Forbes.

The court was told officers were on mobile patrol in the Grove area around 8.53pm, when they observed Moxey in the area acting in a suspicious manner. As a result, they approached the defendant and informed him he would be searched in reference to dangerous drugs and firearms. During their investigation, officers found a homemade crack pipe and small foil wrappings which all contained a white powdery substance in Moxey’s right pocket.

He was subsequently arrested and transported to the Drug Enforcement Unit. When he was questioned by police there, he owned up to the offence and said he bought the drugs for $12.

During the hearing, Moxey told the magistrate he was using the cocaine because he “could not find the normal antibiotics” for his condition. However, Magistrate Forbes told the accused using cocaine would only “exacerbate” his health issues.

In response, Moxey said he had come to that realisation as well. “I wouldn’t be trying that again,” he stated.

As a result, Magistrate Forbes accepted his guilty plea and fined him $100 or one month on remand.
