Man convicted of unlawful sex abandons appeal bid

A 39-YEAR-OLD man convicted of having unlawful sex with a 15-year-old boy has abandoned his bid to appeal his four-year sentence.

Allan Bain, of Pinehurst Drive, Grand Bahama, was found guilty and sentenced to four years in prison in August after he admitted having unlawful sexual intercourse with a 15-year-old boy.

During his hearing before Deputy Chief Magistrate Debbye Ferguson, Bain admitted to being gay.

Bain also told the court that he had known the minor “for some time”, but said they were not in an “exclusive” relationship.

Bain said he was only intimate with the minor for the period in question and he did not know the teenager’s date of birth.

“I know he was young,” he stated.

Deputy Chief Magistrate Ferguson subsequently convicted Bain, but did not impose the maximum possible sentence of five years imprisonment.

“I am deducting one year because of your forthrightness with the court,” she said at the time.

She also informed Bain that he had the right to appeal her decision.

When the matter was called in the Court of Appeal yesterday, Bain’s attorney Bjorn Ferguson informed the court that his client was abandoning the appeal.

As a result, the panel formally affirmed his conviction and the sentence imposed by Deputy Chief Magistrate Ferguson.
