Accused ‘swore at police officer’

A woman cursed at an officer who attempted to arrest her after she allegedly damaged her ex-boyfriend’s car, a court was told.

Prosecutors accused Deandra Barr of smashing the windows and slashing the tyres of her former partner’s car on August 1.

They also accused her of acting in a disorderly manner and resisting arrest when police tried to detain her for the offence.

She denied the allegations when she first appeared before Senior Magistrate Carolyn Vogt-Evans and the matter was adjourned for trial.

When Police Constable 3667 John McKenzie gave evidence, he said around 10.40pm on the night in question, he and a team of officers were dispatched to a disturbance in the Sandilands Village area. He said when they arrived, he saw a man standing next to a car that had all of its windows and tyres damaged.

The court was told that when officers spoke to the man, he told them his girlfriend had damaged his car after they had a verbal argument. PC McKenzie said when he and his team went to the area where the man told them Barr had fled, his female partner approached the accused and informed her that she was being arrested.

“She then began to resist and threw her hands towards the female officer saying: ‘Don’t (expletive) touch me,’” the officer testified. “When she warned her to stop, Barr continued to use obscenities and started to fight (my partner).”

PC McKenzie said that was when he “got involved to help restrain and handcuff” Barr. He said they were able to subdue her and put her in a marked police vehicle a short time later.

He said afterwards, they took her back to the area to see the car she was accused of damaging before taking her to the Elizabeth Estates station to be booked in.

Yesterday, Barr was not represented by an attorney. When she cross-examined PC McKenzie, she suggested that an officer placed a knee on her chest while another one pointed a gun at her private parts when they detained her.

In response, PC McKenzie said he had to use whatever force he needed to restrain her. However, the officer stated he “did not know anything” about a weapon being placed near Barr’s genitals.

The matter continues on February 14, 2022.
