Vagrant to have psychiatric evaluation

A VAGRANT accused of unlawfully entering someone else’s property was yesterday remanded into custody pending a psychiatric evaluation.

Luther Ferguson, Jr, was arrested after he went inside a Skyline Heights building without the permission of its owner on October 22.

He pleaded not guilty when he appeared before Magistrate Kendra Kelly.

After Ferguson, Jr, denied the allegations, his father, who attended the arraignment, told the magistrate his son did have a place to stay, but chose to stay away from home. He also said his son was prone to unpredictable behaviour and asked if he could be evaluated by mental health professionals.

According to court documents, the accused has no fixed address. When questioned, Ferguson, Jr, also claimed that he was homeless and had no desire to live with his father or other family members.

While a magistrate has the jurisdiction to grant bail for the offence of unlawful entry, a accused must have a specified address in order to be released before their trial.

As Ferguson, Jr, insisted that he did not want to reside with his father and had no other address he could offer, she remanded him into custody so he could be evaluated at the Sandilands Rehabilitation Centre.

The accused returns to court on December 14 for a status report.
